1. AGREEMENT TO TERMS
   These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and ANEVO MARKETING, LLC ("we," "us," or "our"), concerning your access to and use of the anevomarketing.com website (the “Site”), as well as any related media form, media channel, mobile website, or mobile application. By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with all of these Terms, you must discontinue use immediately.

   Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby incorporated by reference. We reserve the right, in our sole discretion, to modify these Terms at any time. Changes are effective immediately upon posting, and your continued use of the Site constitutes your acceptance of such modifications.

2. INTELLECTUAL PROPERTY RIGHTS
   Unless otherwise indicated, the Site and all of its Content—including but not limited to source code, databases, software, website designs, text, images, and graphics—and the Marks displayed therein are owned or controlled by us or licensed to us and are protected by applicable intellectual property laws. The Content and Marks are provided “AS IS” for your information and personal use only. You may not copy, reproduce, republish, upload, post, transmit, or distribute any portion of the Site without our express written permission.

   Subject to your compliance with these Terms, we grant you a limited, non-exclusive license to access and use the Site for your personal, non-commercial use only. All rights not expressly granted are reserved.

3. USER REPRESENTATIONS
   By using the Site, you represent and warrant that:

   • All registration or other information you submit is true, accurate, current, and complete.

   • You will maintain and promptly update such information as necessary.

   • You have the legal capacity to agree to these Terms and will comply with all applicable laws.

   • If you are a minor, you have received parental permission to use the Site.

   • You will not access the Site using automated means (e.g., bots, scripts).

   • Your use of the Site will not violate any applicable law or regulation.

   If any information you provide is untrue, inaccurate, or incomplete, we reserve the right to suspend or terminate your account and access to the Site.

4. USER REGISTRATION
   You may be required to register for an account on the Site. You agree to keep your password confidential and accept responsibility for all activity under your account. We reserve the right to remove or change any username deemed inappropriate or objectionable.

5. FEES AND PAYMENT
   Our services include cold email solutions—such as email sequencing, list scraping, and other agency services—that may require payment. By making a purchase, you agree to provide accurate and current billing information. We accept payment via Stripe, wire transfer, and ACH. All fees are in U.S. dollars, and we reserve the right to modify pricing or correct any errors in pricing even if payment has already been made.

6. CANCELLATION
   You may cancel your subscription at any time by contacting us at admin@anevomarketing.com. Cancellation will take effect at the end of the current paid term. At this time, we do not offer refunds beyond the terms of cancellation.

7. PROHIBITED ACTIVITIES
   You agree not to use the Site for any purpose other than as permitted under these Terms. Without limiting other provisions in these Terms, you agree that you will not:

   • Systematically retrieve or copy data from the Site without our express written permission.

   • Engage in fraudulent, misleading, or otherwise illegal activities.

   • Circumvent or disable security features of the Site.

   • Use information from the Site to harass, abuse, or harm another person.

   • Use the Site in any manner that violates applicable law or regulation.

   • Engage in any conduct that could damage or interfere with the operation of the Site.

8. USER GENERATED CONTRIBUTIONS
   The Site may allow you to post or contribute content ("Contributions"). All Contributions you submit are non-confidential and become our property. By submitting Contributions, you grant us a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use, modify, reproduce, and distribute such Contributions. You represent that you have all rights necessary to grant this license. We reserve the right to edit, relocate, or remove any Contributions at our discretion.

9. SUBMISSIONS
   Any feedback, questions, suggestions, or other submissions ("Submissions") provided to us regarding the Site are non-confidential and become our property. We may use such Submissions without any obligation or compensation to you.

10. THIRD-PARTY WEBSITES AND CONTENT
    The Site may contain links to third-party websites or resources. We do not control and are not responsible for the content or practices of any third-party websites. Your interactions with third-party sites are governed solely by your own risk and subject to their respective terms and policies.

11. SITE MANAGEMENT
    We reserve the right, but are not obligated, to monitor the Site for compliance with these Terms and to take appropriate legal action against any violation, including suspending or terminating your access to the Site and/or removing any content deemed objectionable.

12. PRIVACY POLICY
    Your use of the Site is also governed by our Privacy Policy, which is incorporated herein by reference. Please review the Privacy Policy to understand our practices regarding your personal information.

13. COPYRIGHT INFRINGEMENTS
    We respect the intellectual property rights of others. If you believe that any material on the Site infringes your copyright, please notify us immediately at admin@anevomarketing.com with the relevant details so that we may address your claim.

14. TERM AND TERMINATION
    These Terms will remain in effect while you use the Site. We reserve the right to terminate or suspend your access to the Site at any time, without notice, for any reason, including a breach of these Terms. Upon termination, all rights granted to you under these Terms will immediately cease.

15. MODIFICATIONS AND INTERRUPTIONS
    We reserve the right to modify, suspend, or discontinue any aspect of the Site at any time without notice. We are not liable for any modifications, price changes, interruptions, or discontinuances of the Site.

16. GOVERNING LAW AND DISPUTE RESOLUTION
    These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any disputes arising from or related to these Terms or your use of the Site shall be resolved exclusively in the appropriate state or federal courts located in Michigan, and you consent to the jurisdiction of such courts.

17. CORRECTIONS
    There may be information on the Site that contains errors or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to update the information on the Site at any time without prior notice.

18. DISCLAIMER
    THE SITE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, AND WE ARE NOT RESPONSIBLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES.

19. LIMITATIONS OF LIABILITY
    IN NO EVENT SHALL ANEVO MARKETING, LLC, ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR LIABILITY, WHETHER IN CONTRACT, TORT, OR OTHERWISE, shall be limited to the amount you paid (if any) for accessing the Site during the six (6) months preceding your claim.

20. INDEMNIFICATION
    You agree to indemnify and hold harmless ANEVO MARKETING, LLC, its affiliates, officers, agents, and employees from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your breach of these Terms, or your violation of any rights of a third party.

21. USER DATA
    We maintain data that you provide to the Site for its operation. Although we perform routine backups, you are solely responsible for any data you transmit. We are not liable for any loss or corruption of such data.

22. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
    Your use of the Site, including sending emails and completing online forms, constitutes electronic communications. You consent to receive communications from us electronically, and you agree that all such communications satisfy any legal requirement for written notice.

23. MICHIGAN USERS AND RESIDENTS
    If you are a resident of Michigan and have a complaint that is not satisfactorily resolved, you may contact the appropriate consumer protection agency in Michigan for further assistance.

24. MISCELLANEOUS
    These Terms, together with any policies or operating rules posted on the Site, constitute the entire agreement between you and us regarding your use of the Site. If any provision is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
